Total Buzz posted yesterday about how Adam Probolsky is running circles around the anti-property rights side in San Clemente's Shorecliffs War.
Adam commented on how they are making him the central issue. I had the same conversation with Adam this weekend, and he's right. The pro-height restrictions crowd is overly focused on Adam's role as a paid consultant to the anti-height restrictions group -- and if they remain distracted, they will pay a political price.
Personally, I hope they remain distracted, because it makes it more likely the councilmen who voted for the height restrictions will be replaced in the November election.
Anti-property rights crowd? What about the people who bought homes with views - and paid a premium price for them? Do they have property rights too or are only those who want to destroy other people's views and property values entitled to "property rights"? By the way, I do not live in San Clemente, have no view from my home and don't know anyone who is impacted by the SC situation. But calling such selfish behavior on the part of people who just want what they want and to hell with everyone else is disgusting to me.

When you buy property in California (or any other state for that matter), you are entitled to the use of the property within the boundaries of the parcell. That is it. No more, no less. So to answer your question, no, your property rights do not extend to views, unless you own all the properties along your line of sight that you want to protect.
Should neighbors work together on solutions, Yes. That would be the neighborly thing to do. However it is NOT neighborly to attempt to take away your neighbors right to free enjoyment of their property. Period.
