I'm not sure I can subscribe to this sentiment. If you start with the proposition that crime exists and needs to be prosecuted, is it really better to be "lethargic" than "overly aggressive"?

For this statement to work, one would have to accept that the converse (no crime to prosecute) is true, wouldn't one?
